ABAR LLC is the owner and operator of bitsky.bet and all affiliated websites and mobile versions (the “Site,” “Bitsky,” “we,” “us,” or “our”). We respect your privacy and are committed to protecting it through this Privacy Policy (the “Policy”).

This Policy describes the types of personal information we may collect from you or that you may provide when you use the services offered through the Site (the “Services”), as well as our practices for collecting, using, retaining, protecting, and disclosing your personal information.

Please read this Policy carefully to understand our practices regarding your personal information. If you do not agree with this Policy, you should not use the Site or Services.

We reserve the right to revise, amend, or modify this Policy from time to time. Any updated version will be posted on the Site with a revised “Last Updated” date. Where required by applicable law, we will provide additional notice of material changes.

This Policy is incorporated into and forms part of our Terms and Conditions. Any dispute arising out of or relating to this Policy or our data practices is subject to the applicable dispute-resolution provisions of our Terms and Conditions, unless otherwise required by applicable law.

1. How old do you have to be to use the Services?

We prohibit anyone under the age of eighteen (18) from accessing the Site or using the Services.

We do not knowingly market to, collect, or solicit personal information from anyone under eighteen (18). If you are under eighteen (18), you must not submit personal information to us and must immediately discontinue use of the Site.

If we learn that we have collected personal information from a person under eighteen (18), we will take reasonable steps to delete that information, subject to applicable legal and record-retention requirements.

2. What types of information do we collect about you?

We may collect several types of personal information from and about users of the Site, including information that identifies you or could reasonably be linked to you or your household.

This information may include:

• Name, username, or other unique identifiers;

• Email address and phone number;

• Address, City, Zip code, State and Country

• Date of birth and age;

• Account authentication information;

• IP address;

• Device identifiers;

• Browsing, search, gameplay, and other Internet or network activity;

• Approximate or precise geolocation information;

• Payment and transaction information;

• Payment-wallet information;

• Purchase and redemption history;

• Government-issued identification information;

• Social Security number or taxpayer identification number where required for tax reporting, Prize redemption, verification, or other legal requirements;

• Fraud-prevention and account-security information; and

• Other information you voluntarily provide to us.

Passwords and account credentials. Passwords are protected using industry-standard security measures, including one-way hashing where applicable, and are not stored by Bitsky in readable plaintext form. Bitsky does not have access to a user’s original plaintext password after it has been securely processed for authentication.

This Policy does not apply to information that has been de-identified or information that is otherwise publicly available where applicable law does not treat such information as personal information.

Location Data

We may derive your approximate location, such as your state and city, from your IP address when you use the Platform because geographic eligibility may be required for our promotions and Services.

We and our service providers, including game, fraud-prevention, compliance, or location-verification providers, may also collect precise geolocation information from your device or browser where necessary to verify eligibility or satisfy legal, licensing, security, or compliance requirements.

Where precise device location requires device or browser permission, you will be asked to provide that permission. If you decline, certain games, promotions, or other features may be unavailable where your location cannot be verified.
2.1. Biometric Information

Where identity verification is required, including in connection with certain Prize redemptions, account-security reviews, eligibility verification, fraud prevention, or legal and compliance requirements, our third-party identity-verification provider may collect and process images of your government-issued identification document and a photograph, selfie, or live image of your face.

The identity-verification process may use facial-comparison technology, which may include analysis of facial geometry or similar biometric characteristics, to determine whether the person completing verification matches the person shown on the submitted identification document.

Where required by applicable law, you will be provided with notice regarding the collection, purpose, use, retention, and destruction of biometric information and will be asked to provide any consent or authorization required before such biometric information is collected or processed.

Biometric information is used only for purposes such as:

• Identity verification;

• Eligibility verification;

• Fraud detection and prevention;

• Account security;

• Compliance with applicable legal and regulatory requirements; and

• Protection of the integrity of the Platform.

Bitsky does not use biometric information for advertising or marketing purposes and does not sell biometric information.

Biometric information may be collected, processed, and stored by third-party identity-verification providers acting on our behalf. Such providers are required to protect biometric information in accordance with applicable contractual requirements and applicable law.

We require biometric identifiers and biometric information processed on our behalf to be retained only for as long as reasonably necessary to satisfy the purpose for which they were collected or as otherwise required or permitted by law.

Unless a different retention period is required by applicable law, biometric identifiers and biometric information will be permanently deleted or destroyed no later than the earlier of:

1. The date on which the initial purpose for collecting or obtaining the biometric information has been satisfied; or

2. Three (3) years after your last interaction with Bitsky.

Biometric information will be stored, transmitted, protected, retained, and destroyed using safeguards reasonably designed to protect sensitive personal information and in accordance with applicable law.

2.2. Categories of Personal Information — Notice at Collection

In the preceding twelve (12) months, we may have collected the following categories of personal information, as defined by applicable state privacy laws:

2.3. Sensitive Personal Information

We may collect certain sensitive personal information, including government identification numbers, Social Security or taxpayer identification numbers where required, biometric identifiers, account authentication information, and precise geolocation.

We use sensitive personal information only where reasonably necessary for purposes such as:

• Identity verification;

• Eligibility verification;

• Fraud prevention;

• Account security;

• Location verification;

• Tax reporting;

• Payment or Prize redemption processing; and

• Compliance with applicable laws and regulatory requirements.

We do not use sensitive personal information to infer characteristics about you for advertising purposes.

Sensitive personal information may be disclosed to service providers where reasonably necessary to perform these functions and is not sold for monetary consideration.

3. How do we collect your personal information?

We may collect personal information directly from you when you provide it through:

• Account registration;

• Your profile;

• Identity or eligibility verification;

• Payment methods, purchases, and other financial transactions;

• Prize redemption requests;

• Gameplay activity;

We may also collect certain information automatically through our servers, log files, cookies, pixels, SDKs, analytics tools, and other tracking technologies.

Where required by applicable law, any consent required for non-essential cookies or similar technologies will be obtained in accordance with our Cookie Policy and applicable law.

4. Do third parties collect my personal information on the Site?

Third-party service providers, advertising providers, content providers, analytics providers, game providers, and other technology providers may use cookies, pixels, SDKs, or similar technologies in connection with the Site.

These technologies may collect information regarding your device, interactions with the Site, gameplay activity, or online activity.

Where such technologies are used for advertising or targeted advertising, applicable privacy rights and preference controls are described in this Policy and our Cookie Policy.

We do not control the independent privacy practices of third parties. Where a third party independently determines how personal information is processed, its processing may be governed by its own terms and privacy policy.

The Site may also contain links to third-party websites. Bitsky does not control those third-party websites and is not responsible for their privacy practices.

We encourage you to review the privacy policies of third-party websites and services before providing personal information to them.

5. How do we use your personal information?

We may use personal information:

• To provide access to the Site and Services;

• To create, administer, and secure your account;

• To recognize you when you return to the Services;

• To verify identity, age, location, and eligibility;

• To process purchases and Prize redemptions;

• To provide and personalize Services;

• To administer promotions;

• To provide customer support;

• To notify you regarding changes to the Services or our policies;

• To carry out our contractual obligations and enforce our rights;

• To monitor and analyze Site traffic and usage;

We may share publicly available information and de-identified or aggregated information where permitted by applicable law.

6.1. Sale and Sharing of Personal Information

We do not sell personal information in exchange for money.

We may disclose certain identifiers, device information, Internet or network activity, and similar information to advertising or analytics providers in circumstances that may constitute a “sale,” “sharing,” or use for targeted advertising under certain state privacy laws.

Where applicable, you may opt out of such processing as described in Section 7.

We do not knowingly sell or share for targeted advertising the personal information of individuals under eighteen (18).

7. What choices do you have over your personal information?

Depending on applicable law, you may have choices regarding the personal information we collect and process.

You may request access to, correction of, or deletion of certain personal information associated with your account.

You may also request closure or deletion of your account through available account settings or by contacting Bitsky.

An account-deletion request does not require us to delete information that we are legally required or otherwise permitted to retain, including information necessary for:

• Tax and accounting obligations;

• Financial and transaction records;

• Fraud prevention;

• Anti-money-laundering requirements where applicable;

• Identity and eligibility verification;

• Legal claims and dispute resolution;

• Regulatory compliance;

• Platform security; or

• Other applicable legal obligations.

Information retained after account closure or deletion will be used only for appropriate retention, security, legal, compliance, fraud-prevention, or similar purposes and will be deleted or de-identified when continued retention is no longer required or permitted.

Account closure or deletion may affect pending transactions, Prize redemption requests, Sweep Coin balances, or other account features. Such matters will be handled in accordance with the applicable Terms and Conditions, Sweepstakes Rules, promotion terms, and applicable law.

Global Privacy Control

Where required by applicable law, we treat a valid Global Privacy Control (“GPC”) signal as a request to opt out of the sale or sharing of personal information and targeted or cross-context behavioral advertising.

A GPC request may apply to the browser or device from which the signal is received. You may therefore need to enable GPC separately on each browser or device you use.

We do not currently respond to legacy “Do Not Track” or “DNT” signals because there is no generally accepted industry standard governing those signals.

8. How long do we retain your personal information?

We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this Policy or as otherwise required or permitted by applicable law.

Retention periods depend on the nature of the information, why it was collected, applicable legal requirements, and our legitimate compliance, fraud-prevention, security, and operational requirements.

In general:

• Account and profile information may be retained while your account remains active and for an appropriate period after account closure.

• Purchase, Prize redemption, payment, and transaction records may be retained as required for tax, accounting, financial, fraud-prevention, dispute-resolution, or other legal and regulatory purposes.

• Identity-verification and compliance records may be retained as necessary to satisfy applicable verification, eligibility, legal, fraud-prevention, or regulatory requirements.

• Biometric information will be retained and destroyed in accordance with Section 2A and applicable law.

• Security and fraud-prevention information may be retained for as long as reasonably necessary to protect Bitsky, its users, and the integrity of the Platform.

• Records relating to legal claims or disputes may be retained for the applicable limitation period or for as long as reasonably necessary to establish, exercise, or defend legal rights.

A request to close or delete an account does not require us to delete information that applicable law requires or permits us to retain.

Personal information retained following an account-deletion request will not be used for unrelated purposes.

When information is no longer reasonably necessary for the purpose for which it was retained, we will delete, destroy, anonymize, or de-identify it in accordance with applicable law and our applicable retention practices.

9. Is my personal information secure?

We maintain administrative, technical, and physical safeguards reasonably designed to protect personal information against accidental loss and unauthorized access, acquisition, use, alteration, or disclosure.

Information provided to us is maintained using systems and safeguards designed to protect personal information.

However, transmission of information over the Internet is not completely secure, and no security system can guarantee absolute protection.

You are responsible for protecting your account credentials and should not share your password or authentication information with others.

If a security incident involving your personal information requires notification under applicable law, we will provide notice to affected individuals and applicable authorities as required by law.

10. State Privacy Rights

Depending on where you live and applicable law, you may have some or all of the following rights:

• Know and access: Request confirmation as to whether we process your personal information and obtain access to certain personal information.

• Correct: Request correction of inaccuracies in your personal information.

• Delete: Request deletion of certain personal information, subject to legal and permitted retention exceptions described in this Policy.

• Data portability: Obtain certain personal information in a portable format where required by law.

• Opt out: Opt out of targeted advertising, the sale or sharing of personal information, or certain profiling activities where applicable.

• Limit sensitive-data processing: Exercise applicable rights regarding sensitive personal information where provided by law.

• Appeal: Appeal a decision regarding a privacy request where applicable law provides an appeal right.

• Non-discrimination: Exercise applicable privacy rights without unlawful discrimination.

10.2. How to Exercise Your Rights

You may submit an applicable privacy request by contacting [email protected] or through available account settings.

We may need to verify your identity before fulfilling certain requests. Verification may be completed through your logged-in account, by matching information you provide against our records, or by requesting additional information where reasonably necessary.

An authorized agent may submit a request on your behalf where permitted by applicable law and where appropriate proof of authorization is provided.

We will respond to verified requests within the period required by applicable law.

Where applicable, access or portability requests may be limited in frequency as permitted by law.

Additional privacy rights may apply depending on your place of residence and applicable law.

11. No Third-Party Rights

This Policy does not create rights enforceable by third parties except where otherwise required by applicable law.

This Policy operates for the benefit of, and may be assigned to, our successors and assigns, including in connection with a merger, acquisition, restructuring, or sale of assets as described in Section 6.
