Bitsky LLC is the owner and operator of bitsky.bet and all affiliated websites and mobile versions (the “Site” or we, us, our, ours, etc.). We respect your privacy and are committed to protecting it through this Privacy Policy (the “Policy”). This Policy describes the types of personal information we may collect from you, the user, (you, your, yours, etc.) or that you may provide to us when you use the services offered by us on the Site (the “Services”), and our practices for collecting, using, keeping, protecting, and disclosing your personal information. Please read this Policy carefully to understand our practices regarding your personal information and how we will treat it. If you do not agree with this Policy, your sole choice is to leave the Site. By accessing or using the Site, you agree to this Policy and consent to our collection, use, disclosure, retention, and protection of your information as described in this Policy.
We reserve the right to revise, amend, or modify this Policy at any time and in any manner. We will consider your continued use of the Site after we make changes to this Policy as your acceptance of the changes, so you must periodically revisit this Policy and check the “Last Updated” date above. If changed, this Policy has been updated or edited, and the updated or edited version supersedes any prior versions immediately upon posting.
This Policy is incorporated into and forms part of our Terms and Conditions. Any dispute arising out of or relating to this Policy or our data practices - including claims relating to cookies, pixels, SDKs, analytics, or other tracking technologies - is subject to the dispute-resolution provisions of the Terms and Conditions, including the requirement of individual binding arbitration and the waiver of class actions, and to the informal dispute resolution process described in Section 5 of the Terms and Conditions, unless you have validly opted out of arbitration as described there.
1. How old do you have to be to use the Services?
We prohibit anyone under the age of eighteen (18) from accessing the Site or using the Services. We do not knowingly market to or collect or solicit any information from or about anyone under the age of eighteen (18). If you are under the age of eighteen (18), you must not submit information to us and must immediately leave the Site. If we learn that we have collected information from or about a person under the age of eighteen (18), we will delete that information as quickly as possible. 2. What types of information do we collect about you?
We may collect several types of “personal information” from and about users of the Site, including any information that personally identifies you or that could be reasonably linked to you or your household, including your name; alias; username or other unique personal identifier, password, and security questions and answers; postal, billing, and shipping address; email address; IP address and other Internet network activity information such as browsing history, search history, and online interactions; device ID; geolocation data; payment wallet information, social security number (only in certain instances involving withdrawal of Prizes of a certain value); order history;. However, this Policy does not apply to personal information that has been de-identified or that is otherwise publicly available.
Location data. We derive your approximate location (state and city) from your IP address each time you use the Platform, because state eligibility is a legal requirement of our promotions. We and our service providers, including licensed game providers operating certain games within the Platform, may also collect precise geolocation from your device or browser to verify your location and satisfy legal, licensing, and compliance obligations. Where precise device location is collected, you will be asked for the applicable device or browser permission first, and may decline, though some games or features may be unavailable where your location cannot be verified.
2A. Biometric Information Where we require identity verification - for example, before processing certain Prize redemptions - our third-party identity-verification provider collects, on our behalf, images of your government-issued ID and a self-portrait photo, and may use facial comparison technology (which can involve analysis of face geometry) to confirm you are the holder of the ID. This is used solely to verify your identity, comply with legal obligations, and prevent fraud. We do not use biometric information for marketing, do not sell it, and do not use it to make decisions unrelated to identity verification.
We contractually require our identity-verification provider to retain biometric identifiers and biometric information no longer than the earlier of (a) the date the purpose for collection has been satisfied, or (b) [three (3) years] after your last interaction with us, unless a longer period is required by law, after which they are permanently destroyed.
2B. Categories of Personal Information (Notice at Collection) In the preceding 12 months, we have collected the following categories of personal information, as defined by applicable state privacy laws. Retention periods are described in Section 8.

2C. Sensitive Personal Information We collect certain sensitive personal information - including government ID numbers, Social Security or taxpayer identification numbers (where required for tax reporting or Prize redemption), biometric identifiers, account login credentials, and precise geolocation. We use this information only for identity verification, eligibility, licensing and compliance, fraud prevention, tax reporting, and account security, and not to infer characteristics about you. It is disclosed only to identity-verification, compliance, and fraud-prevention providers as necessary for these purposes, and is never sold or shared.
3. How do we collect your personal information?
We collect your personal information directly from you when you provide it to us, such as through:
• The account registration process;
• Your profile information;
• Your payment method, purchases, and other financial transactions;
• Your gameplay history;
• Your responses to any surveys we ask you to complete;
• Your other communications and interactions with us, whether by contact form, phone, mail, email, text, or other means, including on third-party social media platforms; and
• Our technologies, including our servers, log files, cookies, pixel tags, and analytics services.
We also collect your personal information automatically from your computer device or mobile phone and through cookies, web beacons, and other tracking technologies.
This Policy does not apply to information collected by us offline or through any other means, or by any third party that is linked to or accessible through the Site.
4. Do third parties collect my personal information on the Site?
Third parties including users, advertisers, content or application providers, and third-party plugins may provide materials to the site which use cookies, web beacons, or other tracking technologies to collect your personal information, including information about your online activities over time and across different websites and other online services. Those third parties may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control third-party tracking technologies or how third parties use them. Your use of third-party plug-ins are governed by the user terms and privacy policy of the third party that provided that plug-in. If you have any questions about an advertisement or plugin, you should contact the responsible provider directly.
Please be aware that we do not operate, control, or endorse third-party websites that may be linked on the Site, nor are we responsible for the content or privacy practices of third-party websites. We disclaim any responsibility for your personal information on third-party websites, and we do not make any warranties or representations that any third-party website (or even this Site) will function without error or interruption, that defects will be corrected, or that any third-party websites or their servers are free of viruses or other problems that may harm your computer. 5. How do we use your personal information?
We may use your personal information:

6A. Sale and Sharing of Personal Information We do not sell personal information in exchange for money. We do disclose certain identifiers and activity data (such as hashed identifiers, device identifiers, and event data) to advertising partners for cross-context behavioral advertising, which may be considered a “sale” or “sharing” of personal information under some state privacy laws. We have made this disclosure in the preceding 12 months. You may opt out as described in Section 7. We do not knowingly sell or share the personal information of anyone under 18.
7. What choices do you have over your personal information?
We strive to provide you with choices about the personal information you provide directly to us. You can always delete or restrict any personal information that you provided directly to us. We will delete any personal information that you have provided directly to us, if you request to permanently delete your account. However, we may retain your personal information for any use set forth herein. Further, we may refuse to accommodate any change if we believe doing so would violate any law or legal requirement or cause the information to be incorrect. We also strive to provide you with choices about the personal information that we collect from you automatically. We do not control third parties’ collection or use of your personal information to serve interest based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way.
8. How long do we retain your personal information?
Except as otherwise permitted or required by applicable law or regulation, we will retain your personal information only for as long as necessary to fulfill any use of your personal information set forth herein. However, we reserve the right to retain publicly available information and deidentified information for any legitimate business purpose without further notice to you or your consent.
We retain personal information for as long as your account is active and as needed afterward for the purposes described in this Policy. Retention depends on the type of information and purpose: account and profile data are kept for the life of the account; purchase, redemption, and transaction records are kept as required by tax, accounting, anti-money-laundering, and gaming laws; verification records are kept as required for compliance; biometric information follows the schedule in Section 2A; and fraud-prevention records are kept as needed to protect the Platform. When retention is no longer required, we delete or de-identify the information.
9. Is my personal information secure?
We are committed to data security, and we have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, change, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. However, you understand and agree that the transmission of your personal information over the Internet is not completely secure. While we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through the Site. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures used by the Site.
If a security incident affecting your personal information requires notice under applicable law, we will notify you and the relevant authorities as and when the law requires.
10. State Privacy Rights
10A. Your Privacy Rights Depending on where you live, you may have some or all of the following rights regarding your personal information:
• Know and access: confirm whether we process your personal information and obtain a copy of it.
• Correct: fix inaccuracies in your personal information.
• Delete: request deletion of your personal information. You may also delete your account directly in account settings. Because we must verify your identity and eligibility to lawfully operate the Platform, deleting information required for those purposes will result in closure of your account, and pending or unredeemed balances may be forfeited as described in the Promo Rules.
• Opt out: of targeted advertising, of any sale or sharing of personal information, and of certain profiling used in decisions producing legal or similarly significant effects.
• Limit sensitive data processing: where applicable law provides this right. We process sensitive data (such as verification documents and biometric data) only as strictly necessary to provide the Platform and meet legal obligations.
• Appeal: if we decline your request, you may appeal by replying to our decision; we will respond as applicable law requires. If your appeal is denied, you may contact your state Attorney General.
• Non-discrimination: we will not deny you the Platform, charge different prices, or provide a different level of service because you exercised a privacy right, except where a difference is reasonably related to the value of information involved in a voluntary loyalty or promotional program, or where the information is necessary to provide the Platform.
How to exercise these rights. Submit a request by emailing [email protected] or through account settings. We will verify your request using your logged-in account or by matching information against our records, and may request additional information for sensitive requests. An authorized agent may submit a request on your behalf with proof of authorization. We will respond within the time required by applicable law. Where permitted, access and portability requests may be made up to twice in any 12-month period.
• California: We do not permit users from California.
• Connecticut: We do not meet the triggers of the Connecticut Data Privacy Act.
• Delaware: We do not permit users from Delaware.
• Idaho: We do not permit users from Idaho.
• Illinois: We do not permit users from Illinois.
• Indiana: We do not permit users from Indiana.
• Louisiana: We do not permit users from Louisiana.
• Maine: We do not permit users from Maine.
• Michigan: We do not permit users from Michigan.
• Montana: We do not permit users from Montana.
• Nevada: We do not permit users from Nevada.
• New York: We do not permit users from New York.
• Tennessee: We do not permit users from Tennessee.
• Washington: We do not permit users from Washington.
11. No Third-Party Rights
This Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the Services.
This Policy operates for the benefit of, and may be assigned to, our successors and assigns, including in connection with a merger, acquisition, or sale of assets as described in Section 6.
